Terms of Service

Agreement to these terms

These Terms of Service (the "Terms") are a binding agreement between you and Forge180, LLC, a Virginia limited liability company ("Forge180," "we," "us," or "our"), covering your use of forge180.com and the Forge180 application (the "Service").

By ticking the box that says you agree to the Terms of Service and Privacy Policy, by continuing with Google, or by using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Please read "Disclaimers and liability" and "Governing law and disputes" (arbitration and class action waiver) carefully. They affect your legal rights.

Eligibility

You must be at least 18 to use the Service. The Service is offered to users in the United States; we do not offer it to individuals in the European Economic Area, the United Kingdom, or Switzerland. You represent that the information you give us is accurate and that no applicable law bars you from using the Service.

Your account

Accounts are for one person. You are responsible for everything that happens under yours and for keeping your credentials confidential. Do not share them or use anyone else's. Tell us at support@forge180.com straight away if you suspect unauthorized use, and email that address from your account to close it.

Trial, subscription, and billing

New accounts include a free trial, one per person, of the length shown on our pricing page and at signup. Unless you cancel before the trial ends, your subscription begins automatically at the price and billing interval shown to you at checkout, and renews on that interval until you cancel. You authorize us and our payment processor to charge your payment method on that recurring basis. Prices are in US dollars and exclude tax. If a charge fails we may retry it and may suspend access until it succeeds.

We may change our prices, but an increase will not apply to your subscription while it stays continuously active, and we will give you at least 30 days' notice by email before any change that does affect you.

You can cancel at any time from your account settings — or, if you can't access your account, by emailing support@forge180.com. There is no contract, no minimum term, and no cancellation fee. Cancel during the trial and you are never charged. Cancel during a paid month and you keep access to the end of the period you paid for. Except where the law requires otherwise, payments are non-refundable and we do not refund partial periods or unused time. If something has gone wrong, though, email us and we will look at it.

What your subscription includes, and any usage limits that apply to it, are described on our pricing page. The Service changes as we develop it, and we may add, modify, or remove features and limits. Where a change would materially reduce what your plan includes, we will give you notice under "Changes to these terms" so you can cancel.

Our content and your license

Everything in the Service that we provide is owned by us or our licensors and protected by copyright, trademark, trade secret, and other laws. That includes our questions, passages, answer choices, explanations, curriculum, taxonomy, analytics, software, design, and the Forge180 name and logo. All rights not expressly granted are reserved, and none of it is licensed examination content.

Subject to these Terms and payment of any fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own individual test preparation. You may print or save reasonable portions for your own study. No ownership passes to you.

If you send us suggestions or bug reports, we may use them without obligation to you.

Acceptable use and the question bank

Our questions, passages, answer choices, explanations, difficulty and question-type labels, and the taxonomy that organizes them (the "Question Content") are among the most valuable things we provide, and they derive much of that value from not being publicly available. The Question Content is confidential and is not published. It is available only inside the Service, only to subscribers, and your access is given on the condition that you keep it that way.

You may not:

  • Copy or extract it in bulk, whether by scraping, crawling, automated download, systematic screen capture, or calling our APIs outside the app.
  • Publish, post, distribute, sell, rent, or sublicense it, or disclose it to anyone who is not a Forge180 subscriber, including on forums, social media, group chats, shared drives, flashcard or note-sharing sites, or in any product, book, or course.
  • Use it to teach, tutor, or coach anyone else, or in any classroom, group, or commercial test-prep setting, without a written license from us. Working through the Service with someone is fine when you each hold an active Forge180 subscription, so a tutor and a student who are both subscribers may use it together.
  • Use it to train, fine-tune, benchmark, or evaluate any machine learning model, or to generate derivative questions, explanations, or datasets by automated means.
  • Create derivative works from it, including translations, rewrites, and "inspired-by" question sets.

You also may not share your account, interfere with or probe the Service, circumvent rate or usage limits, reverse engineer it, upload malware or unlawful content, or use it in violation of any law or of the rules of any testing organization.

These restrictions survive your subscription and apply to any Question Content you keep in any form, and to anyone acting through your account.

Enforcement. Unauthorized copying or disclosure causes harm money cannot readily measure, so we may seek injunctive relief without posting a bond, in addition to any other remedy, and may terminate your account immediately without refund. If you want to use our questions another way, whether for a class, a tutoring practice, or research, email legal@forge180.com and we will consider it.

AI features and results

The AI tutor and guided walkthroughs are generated by large language models, and AI output can be incomplete, out of date, or wrong. It is for test preparation only, not legal, admissions, or professional advice, and you should not submit confidential information to it. The "AI features" section of our Privacy Policy explains how those messages are handled.

Nothing we publish is a guarantee of any LSAT score, score increase, or admission outcome. Results depend on your effort and starting point, and any figures we publish describe past results for other people.

Your content

Your notes, answers, tutor messages, and feedback are yours. You grant us a worldwide, non-exclusive, royalty-free license to host, store, and process them solely to operate and improve the Service for you, including sending them to the providers named in our Privacy Policy. That license ends when you delete the content or your account, apart from routine backups and records we must keep. We may use aggregated, de-identified data, such as accuracy rates by question type across all users, to improve the product. It does not identify you.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, if your use creates risk or legal exposure, if payment fails, or if the law requires it. Where the circumstances allow, we will give notice and a chance to fix it.

We may also discontinue the Service, and will give reasonable notice if we shut it down entirely. When your account ends, your license ends and we may delete your content in line with our Privacy Policy, so save anything you want to keep first. "Our content and your license," "Acceptable use and the question bank," "Your content," "Disclaimers and liability," "Governing law and disputes," and "General, and how to reach us" survive.

The Service relies on third parties for AI, email, hosting, payments, and Google sign-in, and may link to other sites. We do not control them and are not responsible for them.

Disclaimers and liability

The service is provided "as is" and "as available," without warranty of any kind. To the maximum extent permitted by law we disclaim all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, that content will be accurate or complete, or that use of it will produce any particular result.

To the maximum extent permitted by law, neither Forge180 nor its officers, employees, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, study time, test scores, or admission or scholarship opportunities. Our total liability for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim arose or one hundred US dollars ($100).

Some jurisdictions do not allow these exclusions, so parts may not apply to you. Nothing here limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. These limits apply even if a limited remedy fails of its essential purpose.

You agree to indemnify Forge180 and its officers, employees, and agents against claims, damages, liabilities, and reasonable legal fees arising from your content, your use of the Service, or your breach of these Terms or of applicable law.

Governing law and disputes

11.1 These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of laws rules, and by the Federal Arbitration Act as to 11.3. Any court proceeding permitted by 11.6 or 11.7 will be brought in the state or federal courts of Virginia, and both of us consent to jurisdiction and venue there.

11.2 Before starting a formal proceeding, email support@forge180.com describing the dispute and the relief you want, and give us 30 days to resolve it. We will do the same for you.

11.3 If that fails, you and Forge180 agree to resolve the dispute by final and binding individual arbitration, administered by a recognized provider under its consumer rules, rather than in court.

11.4 You and Forge180 agree to bring claims only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. If this waiver is unenforceable as to a claim, that claim alone proceeds in court.

11.5 You may opt out of 11.3 and 11.4 by emailing legal@forge180.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out changes nothing else.

11.6 Either of us may bring a qualifying individual claim in small claims court, or seek injunctive relief in court to stop misuse of the Service or infringement of intellectual property.

11.7 If applicable law does not permit this arbitration agreement to bind you, 11.3 and 11.4 do not apply to you, and you keep any mandatory protections that law gives you.

Changes to these terms

We may update these Terms. We will revise the "Last updated" date, and for material changes we will give you notice by email or in the Service before they take effect. Changes never apply retroactively to a dispute already raised. Continuing to use the Service after a change takes effect means you accept it; if you do not, cancel before then.

General, and how to reach us

These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is unenforceable it is limited to the minimum extent necessary and the rest stands. Our failure to enforce something is not a waiver. You may not assign these Terms; we may, to an affiliate or in a merger or sale of assets. Neither of us is liable for delays beyond our reasonable control. These Terms create no third-party rights and no partnership, employment, or agency relationship. We send notices to the email address on your account, so keep it current.
